Common Projects That Require Permits

A building permit is required for any addition, alteration, demolition, replacement, or new construction prior to the start of work, including but not limited to:

  • Interior & Exterior Renovations: Kitchen, bathroom, basement remodeling, additions

  • Electrical & Plumbing Work

  • Heating & Air Conditioning Systems (New & replacements)

  • Roofing

  • Hot Water Heaters (Expansion tank required)

  • Decks, Patios & Walkways

  • Fences

  • Fireplaces, Wood Stoves, Fire Pits, Chimneys

  • Pergolas & Gazebos

  • Sheds & Detached Garages

  • Swimming Pools, Hot Tubs & Spas

  • Whole House Generators

  • Solar Panels & EV Charging Stations

  • Driveway Expansions

Permit Requirements for Specific Projects

  • Additions, Roof Structures, Sheds, Patios, Decks, Swimming Pools, Generators

    • Setback requirements vary by zoning district.

    • Applications must include a site plan showing placement on the property.

  • Fences

    • A permit is required for new or replacement fences.

    • Fences cannot be placed directly on the property line—at least a 2-inch setback is recommended.

    • The finished side must face outward toward the neighboring property.

    • Height and material restrictions apply.

Property Maintenance & Safety

Property Standards Enforcement

Montgomery Township enforces minimum property standards on a complaint and observation basis. Residents and business owners are expected to maintain their properties to ensure a safe, clean, and attractive community.

Common concerns include:

  • Accumulation of rubbish and debris

  • Grass and weed maintenance

  • Sidewalk maintenance and clearance

Sidewalk Snow Removal:

  • Private sidewalks (including those in side and rear yards) must be cleared within 24 hours after snowfall.

  • A 30-inch-wide pathway must be maintained.

Drainage & Stormwater Management

Residents should be mindful when managing drainage on their property:

  • Do not redirect water onto neighboring properties, sidewalks, or streets.

  • Ensure that pipes and drains do not create a nuisance on any public sidewalks, streets, or neighboring properties.

  • Illegal Discharges: It is illegal to connect downspouts, floor drains, and sump pumps to the sanitary sewer system.

How long does the permit process take?

  • Residential permit applications typically take 2–3 weeks, depending on volume. Ensure all applications and drawings are complete for a timely review.

Do I need approval from my Homeowners Association (HOA)?

  • Yes. A copy of HOA approval must be submitted with permit applications for all exterior projects.

How do I schedule an inspection?

  • Each permit includes a list of required inspections. To schedule, contact the Planning & Zoning Office at least 24-48 hours in advance at 215-393-6920.

How can I find my property lines?

  • The Planning & Zoning Office has site plans for most properties, but only a licensed surveyor or civil engineer can determine exact property lines.

Do I need a permit to open a business in the Township?

  • Yes. A Non-Residential Use & Occupancy Permit is required to ensure compliance with Township regulations. A Business License may also be required.

Do I need a permit for a home-based business?

  • Yes. The Township Zoning Ordinance regulates home-based businesses. Some are permitted with restrictions, while others are not allowed. A permit is required under Section 230-149 of the Code of Montgomery Township.
